This Privacy Policy describes how Madonna Holdings DBA Stack-Labs ("Company," "we," "us," or "our") collects, uses, and shares information in connection with your use of the Nochi application for macOS (the "App"). By downloading, installing, or using Nochi, you agree to the collection and use of information in accordance with this Privacy Policy.
We are committed to protecting your privacy. Nochi is designed with a local-first architecture, meaning the vast majority of your data never leaves your device.

2. Information We Collect
2.1 Information Stored Locally on Your Device
The following information is stored exclusively on your local device and is never transmitted to our servers or any third party:
- App preferences and settings (theme, layout, feature toggles)
- Calendar data displayed in the notch (sourced from your local macOS Calendar)
- Music playback data (sourced from your local media applications)
- Battery status information (sourced from macOS system APIs)
- Files placed on the file shelf (stored temporarily in local memory)
- Camera mirror data (processed locally, never recorded or stored)
- Character animation states and preferences
2.2 Information Processed by Third Parties
AI Chat Feature: When you use Nochi's AI chat feature, the text of your questions and prompts is sent to Anthropic's Claude API for processing. This is the only feature in Nochi that transmits any user-generated content off your device. Specifically:
- Your chat messages are sent to Anthropic (Claude) to generate responses.
- Anthropic processes these messages in accordance with their own privacy policy. You can review Anthropic's privacy policy at anthropic.com/privacy.
- We do not store, log, or retain your AI chat messages on our servers.
- Chat history may be stored locally on your device but is never synced to any external server.
2.3 Payment Information
When you purchase a subscription or lifetime license for Nochi, your payment is processed by Stripe, Inc. We do not collect, store, or have access to your full credit card number, debit card number, or bank account information. We receive from Stripe only:
- A confirmation of your payment status
- Your email address (for license delivery and account management)
- A Stripe customer ID (for managing subscriptions and processing refunds)
- Transaction amounts and dates

2.4 Analytics and Diagnostics
We may collect anonymized, aggregated usage data to improve the App. This data does not identify you personally and may include:
- App version and macOS version
- General feature usage frequency (e.g., which features are used most)
- Crash reports and error logs
You may opt out of analytics data collection in the App's settings.
3. How We Use Your Information
We use the limited information we collect for the following purposes:
- To provide and maintain the App's functionality
- To process your payments and manage your subscription or license
- To provide AI chat responses via Anthropic's Claude API
- To send transactional communications (purchase confirmations, license keys, important service updates)
- To improve the App through anonymized analytics
- To respond to your support requests
- To comply with legal obligations
5. Data Retention
Because Nochi operates on a local-first architecture, most of your data exists only on your device. Specifically:
- Local data: Retained on your device until you uninstall Nochi or manually delete it. We have no access to this data.
- AI chat messages: Not retained by us. Anthropic's retention policies apply to data processed through their API.
- Payment records: Retained by Stripe in accordance with their data retention policies and applicable financial regulations. We retain transaction records for accounting and legal compliance purposes.
- Analytics data: Anonymized analytics data may be retained indefinitely as it cannot be linked to individual users.

We implement commercially reasonable security measures to protect the information associated with your use of the App. These include:
- HTTPS/TLS encryption for all data transmitted between your device and third-party services (Anthropic, Stripe)
- Local-first architecture ensuring most data never leaves your device
- No server-side storage of personal user data
However, no method of electronic transmission or storage is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.
7. Your Rights and Choices
Depending on your jurisdiction, you may have the following rights regarding your personal information:
- Access: You may request information about the personal data we hold about you.
- Deletion: You may request that we delete personal data we hold about you. Because most data is stored locally, uninstalling Nochi will delete the majority of your data.
- Opt-Out of Analytics: You may disable anonymized analytics collection in the App's settings.
- AI Chat: You may choose not to use the AI chat feature, in which case no data will be sent to Anthropic.
- Manage Payments: You may manage your subscription or request a refund through the methods described in our Terms of Service.
7.1 California Residents (CCPA)
If you are a California resident, you have the right to: (a) know what personal information is being collected about you; (b) know whether your personal information is sold or disclosed and to whom; (c) say no to the sale of personal information; (d) access your personal information; and (e) equal service and price, even if you exercise your privacy rights. We do not sell your personal information.
7.2 European Economic Area Residents (GDPR)
If you are located in the EEA, your personal data is processed on the legal basis of: (a) your consent (which you may withdraw at any time); (b) the necessity of performing our contract with you; or (c) our legitimate interests in operating and improving the App. You have the right to lodge a complaint with a supervisory authority.
8. Children's Privacy
Nochi is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us and we will take steps to delete such information.
9. Third-Party Links and Services
The App may interact with third-party services (such as Spotify, Apple Music, or macOS Calendar) for functionality purposes. These interactions are processed locally on your device. We are not responsible for the privacy practices of third-party services. We encourage you to review the privacy policies of any third-party services you use.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy within the App or by other appropriate means. The "Last Updated" date at the top of this policy indicates when it was last revised. Your continued use of the App after any changes constitutes your acceptance of the updated Privacy Policy.
